성인이 미성년자와 성관계를 했다면 상대가 관계를 거부하지 않았다고 해도 성적 학대로 보고 처벌할 수 있다는 대법원 판단이 나왔다.
22일 대법원 3부(주심 민유숙 대법관)는 아동·청소년의성보호에관한법률위반 등 혐의로 기소된 군인 이모씨(23)에게 징역 1년6개월에 집행유예 3년을 선고한 원심을 깨고 사건을 고등군사법원으로 환송했다. 아동복지법은 아동에게 음란한 행위를 시키거나 이를 매개하는 행위 또는 아동에게 성적수치심을 주는 성희롱 등의 성적 학대행위를 금지하고 있다.
